I'm not sure if this thread belongs in CSR as it’s a legal issue .


Can private airport security guards write tickets under federal law?

Why are private airport guards working for private companies enforcing the law?

Does the money they collect go to the government or the ADM ? which is a private company , not a crown corporation.

Can any lawyer comment on this ?

La question est pertinente, mais je n'ai pas de réponse. Par contre, j'ai plutôt une autre question.

Je me suis toujours posé la question au sujet de l'autorité de la police du CN (ou CP?). En quoi une police d'une compagnie privée peut avoir une quelconque forme d'autorité ? Je veux dire... je me part une compagnie, je me fais une police, et je peux arrêter des gens?

Il y a souvent la police du CN à côté de chez nous. J'avais déjà posé la question à un officier.

Je ne me rapelle plus de la distance exacte mais en gros ils ont autorité sur une distance de (ex : 500 mètres) de part et d'autre du chemin de fer.

Si quelqu'un commet des méfaits ils sont en position de l'arrêter et de le détenir jusqu'à ce que la SQ vienne chercher le suspect.

Je pense que c’est faux, ils ont autorité partout au Canada mais de façon pratique ils se limitent à un territoire qui longe le chemin de fer.

Outre le CN et le CP, il n’y a pas de compagnie privé qui ont une autorité “policière”.

Oui, le gouvernement te donne le droit. C'est tout.
Comme les agents de sentiers fédéré, ils ont l'autorité.

Mais c’est ridicule qu une corporation acte comme la police. Dans une cas une agent policier CN, temoin que CN demande la fermature d’un investigation de déraillement de train, imagine????
 
D'après ce que j'ai lu cet après-midi ils ont pratiquement les mêmes "droit" qu'un policier "standard" à l'exception des violations du code de la route comme un excès de vitesse.

Par contre ils semble s'en tenir strictement aux lois qui régissent le transport ferroviaire ainsi que la sécurité autour des chemins de fer.

À côté de chez moi il y en a souvent parce qu'il y a eu de nombreux vol dans leur bâtiments.

Si je me trompe pas il refère quand meme au corp policier local des que ca dépasse la prévention et surveillance des installations. (J'imagine que ca simplifie pas mal le respect d'autorité quand la SQ est la , versu juste un constable spécial de la compagnie :|)

CN and CP cops fall under the Federal Railway Act. They are 100% real cops

I never mentioned ABCDE zone in my original message don't know where you are getting that from. That being said it was a little after it, some other people were waiting there and got harassed too, one larger Quebecois guy started yelling. However before the insults pile on , my typical strategy is to have a Time Hortons coffee and chill in the parking lot of the ESSO/ nasty ass ghetto Dorval bar where all the drunk people chill and play VLT. Then when I get a call on the cell , proceed to ABCDE. That being said, someone suggested to me that look they are making bullshit quotas / showing their work as well. That being said, I just paid it, less than 80$ is not worth it to fight ( going downtown on a weekday parking etc.) If it was west island court ie Cour de Montreal maybe but not for this.


But the bigger question of private corporations enforcing federal law (even stupid ones) needs to go to the Supreme Court. If not for the trudeau rent a cops, then for CN "Police" being asked to stop investigating an accident by CN administration. WTF?

By the way in your original message you said you got the ticket because you stayed too long in the pickup zone when picking up your family member or friend or whatever… where was this, if not in the ABCDE zone?

Police officers should be a branch of a government not a private corporation. Then you have situations like CN ( administration) asking CN (Police) to stop investigating train derailments.


By the way there is no evidence that ticket monies actually goes to the government, it could basically go to the ADM or CN, CP, for whatever they want. In fact when a reporter tried to get an answer on how many tickets how much money. CN refused to answer.
