As of December 7, 2008, it is prohibited to sell, rent or place at the disposal of a person equipment designed to increase the power or maximum speed of a moped or motorized scooter.
A private individual who commits an offence is liable to a $500 to $1,000 fine*;
A legal entity that commits an offence is liable to a $600 to $2,000 fine*.
Moreover, drivers of a moped or motorized scooter which has been modified to increase its power may also be in violation of the Highway Safety Code, since the vehicle no longer meets the definition of a moped or motorized scooter, and the driver may not hold the appropriate class of licence to drive the vehicle. Offenders are subject to the following penalties:
A $300 to $600 fine;
Vehicle seizure and impoundment for 30 days.
* Other fees may be added to the fine provided under the Highway Safety Code (contribution to the IVAC crime victims compensation program, registry fees, etc.).
