(CNN)Three-time NASCAR champion Tony Stewart is being sued by the parents of a race car driver killed last year during a caution period at a dirt-track race in upstate New York, the plaintiffs' lawyers announced Friday.

Kevin Ward Jr. was killed August 9 after he got out of his wrecked sprint car and went to confront Stewart during a yellow-flag caution period at Canandaigua Motorsports Park. After one car narrowly missed Ward, Stewart drove by and Ward was struck by the right rear tire of Stewart's car and slung down the track.

Ward, 20, died of massive blunt trauma as paramedics drove him to a hospital.

His parents, Kevin and Pamela Ward, filed a wrongful death suit asking for unspecified financial compensation. The suit was filed in Lewis County, where the family lives.

Stewart was not criminally charged in the incident. On Friday, Stewart was practicing 175 miles away for a NASCAR Sprint Cup race at Watkins Glen International race track on Sunday, an event he skipped last year after Ward was killed. He also skipped the next two NASCAR events.

In September a district attorney in Ontario County, where the on-track incident occurred, said he thought the fact that Ward came down the track into an area where cars were still moving played a big factor in the grand jury's decision not to indict Stewart. District Attorney Michael Tantillo said video showed there were no aberrations in Stewart's driving.

i was skeptical at first, but he DOES seem to GRAB the rear wing as if he was trying to hold himself onto it.
(11:00-11:45 he is clearly holding onto the wing)

Si jamais la famille perds, le juge devrait les condamner de payer les frais d'Avocat de stewart. Ca commencerait peut-être par éviter des poursuite frivole quand le dossier n'est pas très fort! Cliss.... y'a pas été trouver criminellement responsable... qu'elle juge srait assez tata pour le trouver responsable au civil????

In Quebec it's like that I believe.

They will win or Tony Stewart will settle. Look at OJ, he was found not guilty then lost the civil suit. Basically what the family is suing for is "money that would have been given to them had their son mad it pro" and not "pain/suffering" as you cannot sur for P/S in NY for wrongful death. I say they will ask for 20-30 million. Tony should ask Gene Haas how to hide assets! Everyone knew this was going to happen, and TS lawyers have been prepping for this case for the past year.

The Ward family isn’t the wealthiest family in upstate New York, but they can have one of the “top trial attorneys in the United States” representing them. This is a money grab pure and simple and the timing of the lawsuit is all about getting as much press as possible. There were 363 days between the accident and the lawsuit being filed, the day that the Sprint Cup Series returns to Watkins Glen.

It happened with OJ !Got off on the murder charges but then lost the civil suit. Goldmans never collected on much as OJs Lawyers were very smart by almost everything he had into a trust in Florida. I feel TS will do the same
 
Steward a fait un maneuvre de cochon, puis ward etait probablement enrager par ca vu que j'imagine que Steward a conduit en cochon tout le long. Malgre tout cela, ward reste responsable de ca proper vie durant cet evenement.

Steward etais deja en maneuvre depuis plusieur metres, donc vu que c'etais une sortie de courbe ca trajectoire aura pas changer et ward etais fort probablement conscient qu'il allait passer proche.

inb4 stewart is now worth 45,35$, has nothing to his name, and all of a sudden the house, the cars, the boat and the cottage are all under the name of his new gf lol

Ward did have MJ in his system when he was racing. This is all just to get $$$, tony will most likely just settle out of court for 2-3 million or something, instead of spending 5-6 million and years of this dragging along in the courts. Its a sad state of affairs.

BTW, Tony tried to avoid hitting the kid, its proven, yet these blood suckers are trying to milk the living hell out of the situation, they should just move on like 99% of people do and realize that his son caused his own death by being a moron. Part of me wishes stewart would counter sue for defamation or slander or something and leave them broke.

Le THC contenue dans la marijuana peut rester plusieur semaine dans ton systeme dependant de la quantité que tu consomme. Fumme un 3.5 dans une fin de semaine et je te garantie que rendue au vendredi tu va encore tester positif
 
Ward was in the middle of the track, essentially causing his own death. Exiting the car while cars on track is strictly forbidden until safety crews arrive on scene.

But what hasn't been mentioned yet is: Tony Stewart is the clown WHO PIONEERED GETTING OUT OF HIS CAR TO THROW A TANTRUM. None of the series ever fined Tony for his reckless actions causing delays, damage and general chaos (fat hick bastard). Where do you think Ward got the idea from?

Should the series have disciplined that fat redneck when he got out of his car the first time and every other 178387746783 times he did, it wouldn't be such a popular thing to do after a wreck.

+1 Same here. Although some blame does go on Ward, Stewart clearly wanted to spin the tires to kick up the mud and buzz/scare him at the same time. You can clearly hear him gunning the throttle and staying high on the track instead of going low and following the other cars. Totally senseless death.
