Delais deresonable

I believe that the Code de precedure criminel allows the prosecutor 1 year to charge you after is has been made aware of the charges, therefore 3 years is an unreasonable delay. Someone has to quote an article du droit (article of law), to confirms this . I am NOT A LAWYER.

Toute poursuite pénale se prescrit par un an à compter de la date de la perpétration de l’infraction.
Toutefois, à l’égard d’une disposition spécifique, la loi peut fixer un délai différent ou fixer le point de départ de la prescription à la date de la connaissance de la perpétration de l’infraction ou à la date où se produit un événement déterminé par cette loi.

tu mélange certaine duration

le delai de prescription est clair et net comme delai

se qui ne l'etait pas c'est le delai que pouvait durée les procédures suite au accusations ... (quel etait le delai RAISONNABLE)

3 ans pour un simple ticket ... imaginée pour quelque chose de moindrent complexe .... dans le cas de jordan je pense que ca fesait plus de 5 ans ... et les juges on dits ca va faire le niaisage
 
So when's the date you pass in from of the judge? We want all the details of how you got how of this one using délais déraissonable and how much it costed it in lawyer fees vs the actual fee of the ticket and if it was worth it.
 
Il y a en effet un probleme dans cette propositions

que la personne qui applique la loi pour se financé a toujours crée un certain probleme ethique

mais de toute facon ...se n'est pas le probleme du citoyen la ville a un trou de 200 M$ parce qu'elle n'est pas foutu de suivre les lois en vigueur ....

de toute facon en realité se ne sont que quelque jugement qui sont rejeté a cause de jordan

et le cout et probablement nul ou positif .... un gars qui tiens son boute coute des frais a la ville ,avocats, juge, ect (qu'ils gagnes ou pas).... si la cause tombe a l'eau .... les frais sont en conséquence

Effectivement, l'application de la loi devrait être indépendante de toute considération financière. Je ne voulais surtout pas impliquer le contraire.

Il reste que l'emission des constats d'infractions se calcule comme un revenu pour une ville (et c'est effectivement s'en est un), et tant et aussi longtemps que ce sera l'être humain qui conduit, je suis pas mal certain que le moyenne d'argent qui rentre sera semblable d'une année à l'autre. Ultimement, avec le changement de culture concernant la conduite automobile (et d'autres facteurs) qui s'instaure, il y aura peut être des baisses a long terme, parceque les gens évoluent! (sauf OP lol... mais ça prend toujours des idiots pour nous rappeler la théorie de Darwin) .

Mon argumentation est seulement pour expliquer que les amendes comblent un champs fiscal, qui devrait être rempli d'une autre façon si ce revenu n'existait pas..

L'effet Jordan a eu du bon, mais dans le cas ici qui nous intéresse, ça donne la légitimité a un danger public, de rester un danger public...

j'ajouterai ceci ... que demain matin ...tout le monde devienne des conducteurs exemplaires et sans faille... comme tu le dits il va rester un manque a gagné... ils trouverons bien d'autre regle pour nous faire payez....(si je suis crosseur, en tant que société on a aucun gain a evité les infractions...on va payez pareil lol)

Je dirais plutot le fait qu'il a l'air a se croire invincible et crois vraiment que son auto réagit pareil a 100 km/h qu'a 140 km/h....quand une personne pense de meme, elle a un risque élevé d'etre une personne dangereuse.

Aucune des deux options. Son discours sur le forum ici en dit long sur l'individu...

Mais tu a raison, il est un peu trop tôt pour s'indigner... On attendra qu'il ramasse un enfant dans une zone scolaire avec sa super bagnole qui freine aussi vite à 60kmh qu'a 30....

If you plead guilty to a ticket , you only have 30 days to appeal? correct? Because I just noticed I paid a ticekt, wherre the delay was over expired.

I would like to correct myself, it seems that the ARRET JORDAN ( R v. Jordan ) DOES APPLY TO TICKETS.
18 Month delay without preliminary inquiry , 30 months with preliminary inquiry.


In fact I paid a ticket 40 days ago , accepted a deal from the prosecutor, when the prosecutor knew full well the that the date between the infraction and premier instance en cour was more than 18 months. I am looking at options.

PS: Does assigning or subpoenaing a witness like a police officer , count as a "preliminary inquiry"?
PPS: I am not a lawyer, anything I say may not be correct , but I try.

??? Le taux d'Accident n'a JAMAIS été aussi bas en presque 50 ans!!! Le nombre de loi regressive lui, par contre est effectivement en hausse! ;)

how is driving at 140 on the highway , a speed that's consider cruising speed in many country's of the world the same as someone going over 30 in a school zone and killing kids ?

are you seriously comparing those 2 and calling yourself logical ?

I been driving for 20 yrs , had many speeding tickets , knock on wood never had an accident in 20 fkcin years cause i know how to drive not cause of luck. Get your head out of your ass there is such a thing as evaluating a situation when driving to see what's dangerous or not .

You don't need to be Alain prost to go 40 over the limit on clear highway and not cause an accident.

Also i don't think i'm invincible but were talking about 140 here , not 200 +.

The tolerated speed in quebec is 110-120. Your going to tell me that 120 is fine but OMG 20kmh over that is the line between your car magically losing all control and cause an accident.

Don't go calling people dangerous cause you can't drive for shit .

1. What is the time frame for the transition period to make the JORDAN ruling apply in the Montreal courts.

2. If a prosecutor assigns a witness (ie police officer or in my case the photo radar technician) , is that considered a preliminary hearing , which if its considered a prelim. hearing bumps the time frame from 18 to 30 months to apply for an arret jordan?

jordan already apply ...but you have to ask for it



18 and 30 month if i remember correctly is in what system you are , 18 for ticket and other stuff 30 for criminal

doing some preliminary stuff doesn't absolve them from the 18 month limit ... that was exactly why jordan is there prevent them from going for ever and ever and ever

the photo radar tech is just there to by pass the oui dire defence on the photo radar ... that made crumble the whole photo radar proof... if the tech is present AND the proof is built correctly then it should be ok for the crown

my non lawyer logic would say the status of the prliminary inquiry is irrelevant ...you have an accusation date ... (the ticket date) and your current date .... if bigger than 18 month ...seem's fishy

for how to do it i don't really know ...but i suspect asking the side that is prosecuting you is not the way to do it

for the radar check on a daily basis ... don't know anything about that ...if you have info i would like to read it

i suspect its from the manufacturer ....

if i read in my radar book from the police school they state the WERENKO against queen's bench from alberta

they state when using a normal radar (not photoradar)

it as to be tested before and after the operation to confirm accuracy to make the proof prima facie

current jugement and the one specific to photo radar could be different


where you able to get the instruction manual of the photo radar .. most of them are doppler if i remember correctly and are prone to error .... since the beam is wider than laser

is normally the opeartor job to find out witch target is the right one ...a bit hard to do with only a picture and a speed
