Agree with some others here, the minivan driver is at fault for their own crash based on the limited information presented.
- No mention of side swiping
- Unless the picture was taken hours after the accident (doubtful) the traffic volume is next to nothing
- Wide shoulder to move over into if run out of their lane
It would have been beautiful to have a dash cam vid because raw footage doesn't lie, but I really believe the idiot was situationally oblivious (read: probably looks in their review mirror once a month), got freaked out as a car ripped by and into their lane, freaked out and over compensated passed the shoulder into the barrier. Yes the guys racing we're dumb assholes but the minivan driver need only blame themselves for crashing.
That's my point exactly. We have zero evidence to support any of the arguments. Some people can't admit when they're wrong but I'd be curious to see if anyone else in the "thick" traffic spotted either an M4 - which is a relatively rare car, or a white racebike. The day we have a corroboration from witnesses and a scene reconstruction I'll concede the argument and admit I was wrong.
Until then, I think we need more evidence.
