According to plaintiff Jean-François Bellerose, the black paint on his 2019 Model 3 started peeling off at the bottom of the doors and rocker panels, exposing the body to corrosion and deteriorating the sedan’s value. He contacted Tesla to fix the problem, but the California-based automaker told Bellerose that the damage isn’t covered under warranty.
The class-action lawsuit filing stipulates that it would cost $4,738 to repair the plaintiff’s Tesla Model 3, as paint, a primary anti-chipping primer and coating are necessary to protect the car from corrosion and flaking. In addition, paint coating on a vehicle should exceed the warranty by several years. Bellerose’s car starting shedding its paint after only six months.
The lawsuit also cites the Ministère du Développement durable, de l’Environnement et de la lutte contre les changements climatiques, which stipulates that vehicle owners keep their vehicles more than eight years on average, including one third who keeps them between 11 and 15 years, and that the average useful life of a car is about 250,000 kilometres. And according to CAA-Québec, 80% of automotive manufacturers doing business in Quebec offer a basic warranty against paint surface defects for a period of at least three years. Tesla’s coverage is valid for one year only.
Other Tesla Model 3 owners who’ve experienced similar paint-peeling problems are invited to manifest themselves as well, such as paint degradation while the car was less than three years old, and/or owners who haven’t been informed by Tesla of the paint degradation issues while they were in the process of purchasing or leasing the vehicle. On December 31st, 2019, there were 6,293 units of the Tesla Model 3 registered in Quebec.
In addition, the lawsuit alleges that Tesla was aware of the problem when the car started being sold in Canada, but despite other owners complaining about the issue, the automaker has yet to issue a recall and a fix.
Finally, the class-action lawsuit is seeking the following compensation from Tesla:
The reimbursement of the difference between the car’s sale price and diminished value due to the paint issues, which corresponds to the amount required to fix the problem;
Or
The reimbursement of the excessive-wear costs at the end of the vehicle’s lease period, regarding the paint-peeling issue;
And
A $500 punitive fee for every Tesla Model 3 owner involved in the case.
The Tesla Model 3 class-action lawsuit was filed by Cabinet BG Avocat inc. and CBL & Associés avocats in the Province of Quebec Superior Court for the District of Montreal. If a judge authorizes it, a further announcement will be made inviting other Model 3 owners to join in.
