No, he's actually exempt because he is playing the commercial load exemption. If you and I were to somehow let let in to the USA (we wouldn't) to pickup our sneakers at freeport we would not be exempt. He is importing his goods as a business and he is crossing as a commercial driver. He is exempt and playing one of the loop holes. I only say he is playing a loop hole because it sounds like he is crossing to pickup personal items but passing them off as commercial goods. If he were to cross at the traffic side and not the commercial side and declare the goods as personal items and say that his purpose of travel was to pickup personal items at freeport he would not be exempt.
