Im on a bit of a deadline here as i have a court date tomorrow for an illegal exhaust ticket that i got.
last year I got a ticket for supposedly having an illegal exhaust from an undercover cop downtown montreal. heres what happened.
The officer came to talk to me about my car and told me my exhaust is illegal. he started by saying that i replaced the muffler with a resonator, and finished by saying it is too loud. i laughed a little inside when he said these things since he didnt actually go and inspect the exhaust system to see if this was true.
in regards to the noise level he failed to test the audio decible level with the proper equipment. therefore his statement saying the car is too loud is based only on opinion. i have the disclosure of evidence and have red his notes. his proof in the notes says DEF. REPART:BRUIT. He also did not inspect the car to see if my muffler or resonator had been removed, if he had I could have shown him both.
the only inspection he did was measuring the dimensions of my muffler.
so at this point in time my argument is that his decision is based strictly on his opinion and not facts. now i have already spoken with the prosecutor and she told me that apparently if the officer is considered an expert, then his "opinion" is valid enough to give a citation. I dont think that is true but any help or advice is appreciated.
