They don't pass code indeed (stupid).

Taking a risk is a broad assumption since not everyone has young kids and not everyone let their kids climb on railing.

Horizontal cable railing don't pass... nuance. I don't have the code in front of me but the new code is more prescriptive and less descriptive and I think that the railing must be built in a way the prevent them from being climbed, be able to resit x KN force blablabla.

Local or municipal by laws for balconies are another matter.
