Hi there,

Is it worth contesting a speeding ticket if it can be proven that the radar/peace officer was intently hiding behind an object to conduct their operation?

I'm asking because of how legally the presence of photo radars need to be indicated to motorists when cameras are present.

In other words the officer should have been visible to motorist during their operation for the action to be valid.

I've done this before, any experience of people doing this prior to court? - over the phone a few days before court date?

I've done this 3 times. Had my ticket reduced each time. Email the city 2-3 weeks before your court date and ask for the prosecutor info.
 
Sur place, je jour du ''procès'' , la procureure 9.5/10 était arrivé dans la petite salle d'attente et demandé à tous ceux qui voulait discuter, d'aller la voir. Je me garoche en premier, elle regarde mon dossier et en 3 seconde elle me demande '' As-tu des témoins à faire entendre, parce que moi j'ai mon policier''!! fendante comme 1000.
J'y explique que je veux plaider pour une réduction de peine, et un délai pour le payement, parce que je suis étudiant et fauché raide.
Elle me répond: '' Ok, tu plaides coupables à 170km/h au lieu de 190, ça te fait sauver 250$, et je vais plaider au juge pour le délai, mais ça, c'est rien de garantie.'' Et là, tu sens très bien que l'offre est valide pour 10 seconde ! Tu prends pas 1 ou 2h pour y penser !!

Le gars qui avait passé en avant de moi s'était fait refuser le délai par le juge !! Rendu à moi, je juge a grimacé, et genre '' Je comprend que c'est difficile quand on est aux études, surtout un montant demême (+/- 700$ à l'époque), je vous accorde 1 an pour payer''


woot woot ! ! en perdant 7 pts au lieu de 9, je pouvais aussi garder mon permis ! !

Tl:dr même avec aucun esti arguement, la procureur m'a dealer dequoi d'assez respectable, ça vaut la peine de s'essayer. En plus du policier payé full pine qui s'est déplacé pour rien !! fu mofo ! !
 
I have had my photo radar ticket taken off by prosecutor, however, it was right at the time time of the Bove judgment, (D.P.C.P c. Bove) so I got a gift from the heavens. --Thus I have experience too a bit.

That being said, whether the cop was hiding or in plain sight has no consequence on your case in my opinion. Your best best bet is to ask the prosecutor for a plea deal, .or if it was snowing, or raining , possibly use the argument that the laser beam refracted, but you probably need an expert of some sort for that.

Seul les photos radars doivent être annoncés. (Fixe ou mobile).

Un policier qui fait du séchoir pourrait bien se cacher en ghillie suit dans un buisson s'il le veut. (J'exagère mais vous comprenez)
